These terms are laid out for any puppy born at Indigo Creek Kennels on or after 25th July 2015.Any puppy born before the above date do not come under the terms laid out in this journal - no action must be taken.
~~~ Introduction ~~~
All puppies sold under the terms stated below are from Indigo Creek bloodlines and are between the ages of 10 weeks and 18 months. Any puppy reclaimed by the kennel, will need to have another contract signed by the new owner (if the puppy is under 18 months). If the puppy is reclaimed and is over 18 months of age, a separate Terms of Adult Purchase will be required - Indigo Creek's Terms of Adult Purchase
All puppies born at Indigo Creek will require the following terms to be read and accepted by their new owner before they can be taken home. This applies to both puppies purchased through points as well as through art auctions or draw-to-adopt applications. By submitting your application in the comment section you agree to have read and accept the terms regarding the Indigo Creek puppy. If you have any issues with the terms stated please contact NarniaOrca as to why you do not accept any or all the terms laid out.
~~~ Terms of Puppy Purchase ~~~
The Buyer agrees to;
1) Allow and accept co-ownership* where it is required.
2) Keep the puppy active throughout its life
3) Indigo Creek's Prefix/Suffix must stay on the puppy even after purchase. The adding/taking away of any Prefix/Suffix to the show name is strictly forbidden.
4) Most, if not all Indigo Creek puppies will come with a Show and Call Name - these must not be changed unless stated otherwise.
5) Puppies must be registered with at least one DARPG group, such as; Kennel-Club (preferred), K-C-U-S-A, United Kennel Club, Pedigree Club etc and use the title/point system set out by the group.
6) All Nova Scotia Duck Tolling Retriever puppies born at Indigo Creek must be registered with NSDTRClub
7) Puppies must work towards both Conformation and Sporting titles which are relevant to the breed.
Eg. Border Collies being used in Hunter Retriever trails or NSDTRs being used as sheep herders.
8) Indigo Creek remains the right to request a breeding from the puppy, both the buyer and breeder need to be in full agreement with each other for the breeding to go ahead.
9) The purchased puppy is NOT to breed more than 3 litters for bitches and 4 litters for dogs. If in the instance of artificial insemination where sperm is collected, dogs may breed a further 2 times with an upper limit of 6 litters in his life time.
10) Purchased puppies is NOT to have any litters before the age of 2 years or after turning 5 years of age, whereby they have achieved a minimum of 3 full sets of working titles and 3 conformation titles.
11) To notify Indigo Creek of any breeding arrangements, and may request assistance when needed. Selected breeding partners must be of realistic colourings and follow the Breed Standard as well as fall in the terms of #9 and #10 with the use of the correct genetics.
12) To offer Indigo Creek pick from the litter before public sale. Indigo Creek remains the right to refuse the puppy but must always have a reservation slot of future litters before anyone who is not the breeder/co-breeder of the litter.
13) To ask Indigo Creek for permission before spaying/neutering puppies.
14) To contact Indigo Creek if the puppy can no longer be kept. You must not sell or give the puppy away without getting the written permission from Indigo Creek. If no terms have been broken by the buyer, Indigo Creek is willing to pay half the purchase price of the puppy. The buyer will not be refunded if they have been found to not have followed all the above requirements.
15) Every puppy must remain a puppy for a minimum of 4 weeks before being aged by the buyer's own system.
16) All puppies from Indigo Creek must have a reference sheet uploaded within 1 month of purchase.

~~~ Co-Ownership ~~~
In some cases Indigo Creek may request the co-ownership of a puppy. This means that the puppy will be shared between two kennels with the buyer having the majority control of said puppy. If the buyer is also the co-breeder of the puppy, then the control of the puppy is shared equally between the kennels. Showing, Titling and Breeding plans for the puppy will be discussed - at length - between the owners and must be agreed by both parties. In the case of a co-ownership, both owners must agree to provide equal responsibility to keeping the puppy active.
If the buyer is not seen to be putting in the time and effort required for the co-ownership or any of the terms are seen to have been broken in any way Indigo Creek have the right to re-claim the puppy.

~~~ Activity Tracker ~~~
Indigo Creek will carry out an activity tracker 3 times a year* for puppies born on or after 25th July 2015.
The activity tracker includes;
1) Any purchased puppy must have it's own reference sheet within 2 months of adoption. For the first month we allow the litter sheet image to be used however by the second month you must produce your own image.
2) Any and all art of the purchased puppy must be submitted to the Progeny folder in the IndigoCreekKennels group.
3) Credit must be given to NarniaOrca/ IndigoCreekKennels on the first piece of art of the purchased puppy.
The time or purchase for any puppy is taken as the day the new owner has commented on this journal having read and accepted the Indigo Creek Terms of Puppy Purchase. This is to be done once the owner has filled out the appropriate application form for the puppy and has been approved by Indigo Creek as the new owner. The final conformation of purchase will be to write a comment under this journal with the purchase agreement.
* The activity tracker will cease when the purchased puppy has been listed as either Retired, Deceased or Frozen. Indigo Creek would prefer to have prior warning to when the puppy's activity will change - this will allow the time which would be spent on the track to be used better elsewhere.

I understand that if I am found to have broken any of the terms laid out in this agreement, the puppy will be reclaimed by Indigo Creek.

Indigo Creek would like to post this disclaimer in regards to when a puppy is reclaimed by the kennel. Reclaiming of puppies will only occur with legitimate reasoning, whereby both parties will present evidence for/against the reclaim. Here at Indigo Creek we believe Communication is Key, if you are unsure or have any issues with the terms laid out please get in contact with NarniaOrca who will offer their best assistance.
If you are found to have broken any of the terms set out my this agreement, please expect that the likelihood of you purchasing another Indigo Creek puppy will be low. We will allow for a probational period before validating the purchase of your next puppy or in some extreme cases you will not be allowed to purchase any future puppies bred by Indigo Creek or from dogs of the Indigo Creek bloodline depending on the severity of the violation.
